Discrimination is more than a name calling, or an unfair treatment based on prejudices, or ethnic, and cultural differences. A person??™s religion, disability, ethnicity, gender, and even age, can all be a form of discrimination. Discrimination is not only morally wrong; discrimination is a violation of all human rights.
On October 26, 2010, a compliance issue was brought upon The Nassua County Department of Parks, Recreation, and Museums, for violating the law after firing a 71-year-old man, which led to a lawsuit of discrimination. Age discrimination violates the Age Discrimination in Employment Act of 1967, which protects individuals, 40 years or older from employment discrimination based on age (The U.S. Equal Employment Opportunity Commission,? 2008).
The Equal Employment Opportunity Commission filed a lawsuit against Nassua County, alleging that 71-year-old Jay Lieberfarb, a 50-year experienced lifeguard from New York, was suspended after failing a swim test while other youth lifeguards also failed the same test, but continued their employment. Leiberfard, was fired from his job just two days after his suspension for failing the swim test, and before he completed a retest, which was offered to him to complete within one week.
The Equal Employment Opportunity Commission??™s filed the lawsuit, Civil Action No. CV-10-4471 after first, trying to pursue a settlement through reconciliation seeking monetary relief and reinstatement for Jay Lieberfarb (The U.S. Equal Employment Opportunity Commission,? 2008). The Equal Employment Opportunity Commission coerces federal laws forbidding employment discrimination, and requiring that all workers be treated equal.
The Equal Employment Opportunity Commission??™s filing promotes a diverse opportunity for younger people to engage in social changes. Youth??™s generally stereotype, and discriminate toward older people therefore to have a mixture of different cultures, backgrounds, and ages in employment, are necessary, and vital to the establishment and care of a workplace that will be fair and free of bias??™ against older people. control over the changes aging brings and be made aware of aging??™s certainty, and the way that aging is looked at, and accepted into our society.
In comparison to the Equal Employment Opportunity Commission??™s press release and the news
items that were read, there found to be more similarities than differences. The allegations of the lawsuit clearly state the same thing. According to? CUPA HR eNews,? (2011),? “although the lifeguard was willing to take the 200-meter segment the day of his injury, the test administrators told him he could take it a week later if he provided a doctor??™s note???.? (para. 1). However, Jay Lieberfarb never had a chance to retest because he was terminated before the date to complete the retest or provide a doctor??™s note.
To prevent future discriminations in the workforce, The Nassua County Department of Parks, Recreation, and Museums, and other companies need to have certain strategies implemented in the workplace. To ensure future compliance and inclusion in the multicultural workplace, employees need to first learn and be made aware of the Age Discrimination in Employment Act of 1967 to protect their own rights in the workplace, and how to prevent discrimination. As a senior manager, one should also provide educational trainings to all staff on discrimination in the workplace, have refresher meetings to be sure that the policies and procedures are in enforced, and met, and make sure that employees are well aware of the consequences.
Discrimination of a person??™s age in employment is a serious issue which strikes on many regions of the Government policy and may have indications for individuals as well. Age discrimination not only affects older people, but younger people also in chances of landing a job. Age discrimination can also affect both the young and the old in chances of a promotion, or play a factor in employers trying to decide in who should be selected for redundancy
Discrimination in the work environment is prevalent and has become inferior since the events of (911) on September 11, 2001. Such events as the World Trade Center, and many others like the plane

crash in Pennsylvania, and the Pentagon attack, has caused the world to create a favorable place for discrimination in an out of the work environment. There has been a relevance increase that people of Middle Eastern appearance have been racially or religiously discriminated against since the attacks. Some people, who may have been discriminated against, may have a great deal of fear, isolation, and humiliation that may also cause workplace retaliation.
Once employment and discrimination go hand-in-hand, the people involved may have a lengthy, difficult process to gain justice and recall their rights. The Civil Rights Act of 1964 was constructed to eliminate workplace discrimination. However, there have been continuous violations in enforcement of the law, therefore discrimination in the workplace continues to exist. Bias in age may not happen as much today as it did before, however, in hiring, bias continues to rise in companies of all sizes across the nation. Fortunately, through laws and regulations, there are a number of protections available to American workers.
In conclusion, discrimination of any kind is immoral. People have come a long way in the world and everyone should be able to be respected and treated equally. The honest employers may take the initiative to teach and provide education, trainings, and to help track workplace discrimination to have a safe workplace environment and provide change. There have been major changes in federal laws against employment discrimination with enforcements by the Equal Employment Opportunity Commissions, yet, the responsibility is up to us, we the people, to stand up for equality and do the right thing.
